Terms & Conditions

At Aced It Tutoring, your privacy matters to us. While these Terms outline your use of our services and website, our commitment to protecting your personal information is outlined in our Privacy Policy. By using our Service, you consent to the collection and use of information in accordance with that policy.

Please read these Terms and Conditions (“Terms”, “Terms of Use”) carefully before using the https://acedittutoring.com.au website (the “Service”) operated by Aced It Tutoring (“we”, “us”, or “our”).

By accessing or using this website and engaging with our tutoring services, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please do not use the Service.

1. Use of the Service

Our website provides information about tutoring services, educational content, and resources. You agree to use the Service for lawful purposes only and in a way that does not infringe the rights of or restrict the use of the Service by others.

2. Intellectual Property

All content on this site—including text, graphics, logos, videos, and layouts—is the property of Aced It Tutoring or our licensors and is protected by Australian intellectual property laws. You may not reproduce, republish, or distribute any content without our written permission.

3. External Links

Our website may link to external websites we don’t own or control. While we take care in linking to quality resources, we are not responsible for the content, policies, or practices of any third-party websites.

4. Deposit and Payments

  • A $100 deposit is required upon enrolment.
  • The remaining balance must be paid either:
    • In full prior to the term start, or
    • Through a 9-week direct debit plan.
  • An invoice will be sent prior to the term commencement, detailing payment options and due dates.

5. General Terms and Conditions

  • Tutoring sessions run for 45 or 60 minutes weekly.
  • All accounts must be paid in full or up to date for sessions to proceed. Unpaid accounts will result in the suspension of tuition until resolved.
  • Sessions will be scheduled in advance at a mutually convenient time.
  • Cancellations by the Parent/Guardian still incur the session fee.
  • Missed or cancelled lessons:
    • Cancellations with 24+ hours’ notice: Receive a make-up credit, valid for 2 weeks.
    • Less than 24 hours’ notice: No make-up credit.
    • Maximum of 2 make-up credits per term.
  • By enrolling, you agree to the full term fees. Mid-term withdrawals forfeit all paid fees, and remaining fees under direct debit still apply.
  • Exceptions for extreme circumstances may be considered case-by-case.

6. Pick-up and Drop-off

  • Public parking is available at all locations.
  • Children aged 10 and under must:
    • Be checked in by a parent/guardian.
    • Be collected promptly after the session.
  • We cannot provide supervision outside of scheduled session times.

7. Ongoing Tutoring Agreement

7.1 Agreement to Proceed

By submitting your enrolment, you enter into an Ongoing Tutoring Agreement with Aced It Tutoring.

7.2 Acceptance of Agreement

By checking your acceptance of these terms, you acknowledge your responsibility for adhering to this agreement and its payment terms.

7.3 Termination of Agreement

You may terminate this agreement with 4 weeks’ written notice. Aced It Tutoring may terminate the agreement if:

  • Payments are not made,
  • A conflict of interest arises,
  • Confidence in the service relationship is lost, or
  • For other just cause.

Notice of termination will be provided with at least 14 days’ notice. You are responsible for fees incurred up to the termination date.

8. Costs and Payments

  • Fees are outlined in your invoice, sent 4 weeks prior to term start.
  • Payment is due within 14 days of invoice date.
  • Payments are made via direct debit; details are provided on enrolment.
  • Late payments may incur 20% interest.
  • If you’re unable to make payments, contact us to arrange an alternative.
  • You agree to cover all reasonable costs (including legal fees) incurred in recovering unpaid amounts.

9. Temporary Hold Option

  • Agreements may be placed on hold for up to 1 month with prior notice.
  • All fees must be up to date to qualify.
  • No services or invoices will be issued during a hold.

10. Services Provided

  • Includes: General academic tuition.
  • Excludes: Any services outside of academic tuition.

11. Privacy and Confidentiality

  • Personal information is protected under the Privacy Amendment (Private Sector) Act 2000.
  • Information may be disclosed as required by law or to relevant professionals (e.g., accountants, legal advisers).
  • All consultations and services remain confidential, even after service termination.

12. Indemnity

Aced It Tutoring provides tutoring services with the understanding that neither it nor its staff can be held liable for outcomes, losses, or actions resulting from recommendations or services rendered.

To the fullest extent permitted by law, Aced It Tutoring disclaims all liability arising out of or connected to its services.

13. Disclaimer

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted access or freedom from errors. Results may vary by student.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts in NSW.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service indicates acceptance of the revised Terms.
